Architectural Control Guidelines
Guidelines of acceptable building materials and project designs may be obtained from the Homeowners Association Architectural Review Committee. These guidelines are not all inclusive, but merely provide samples of what has been approved for construction in the past. Each individual request must be submitted to the Architectural Review Committee for approval, prior to the actual start of the projects construction.
The Architectural Review Committee reports to the Homeowner Association Board of Directors.
The Guidelines that are in effect as of August 1, 2001 are as follow:

No improvement of any type shall be constructed, erected, altered, remodeled or placed on any lot without written approval of the Architectural Review Committee (ARC). To facilitate timely review and approval of Plans and Specifications, this guideline is provided for reference. Unless specifically exempted in this guideline, complete Plans and Specifications must be submitted for each project, and written approval must be received prior to the start of work.PROCEDURES
The Protective Covenants for the Smoky Hill 400 Subdivision establish the procedures followed by the ARC. Section 2 of the Covenant addresses procedures for Improvement Requests and for revising these guidelines. Section 9 of the Covenant addresses procedures for Enforcement of the Protective Covenant. Section 9 of the Covenant addresses appeals to decisions of the Architectural Review Committee.
A "Home Improvement Request Form" (Improvement Request) is provided as a guideline for detailing proposed Plans and Specifications to the ARC. The Improvement Request may be altered when Plans and Specifications require more detailed information to adequately address all the issues associated with a request.
Plans and Specifications must be submitted at least ten working days prior to the desired approval date. They must be complete and legible. No verbal approvals are allowed under any circumstances.
Applicable permits and compliance with all City of Centennial and Arapahoe County Building Codes and zoning restrictions are the homeowner's responsibility. ARC approval of submitted Plans and Specifications in no way relieves the homeowner of their obligation to satisfy City and County requirements.
PAINTING & SIDING
Repainting the same color as previously approved by the ARC does not require re-submittal of plans. Other color selections, other than those previously approved by the ARC, require approval prior to the start of painting. Changing the exterior material (adding siding) requires approval prior to the start of construction.
The color choices available from various companies are nearly endless. It is not feasible to list all that are acceptable. BEFORE you start painting or siding, please submit your request for a color change by sending color samples (available at your paint store) along with an Improvement Request. Improvement Requests should include color information for the body and the trim of the house.
Any color that is selected must be within the "soft earth tone" family of colors.
ROOFS
See Section 5 of the Covenants for restrictions on roofs and exterior materials.
Installing a roof the same color and style as previously approved by the ARC does not require re-submittal of plans. Installations other than those previously approved by the ARC require approval prior to the start of construction.
The ARC encourages the use of materials that are approved by insurance companies and the Cunningham Fire Department.
FENCING
Any fence that is installed in Smoky Hill 400 and conforms to these guidelines, will not require approval from the ARC. Any homeowner who wishes to deviate from these guidelines must submit an Improvement Request to the ARC for approval prior to the start of construction.
Approved styles for use in Smoky Hill 400 are of the following seven types:
A = 6’ 1 x 8 Baffleboard
B = 3’ 6" San Lido (wire mesh)
C = 6’ Stockade
D = 3’ Three Rail
E = 5’ Four Rail
F = 4’ Split Rail
G = 6’ Cape Cod
All rear and side property lines, which abut Smoky Hill Road, South Telluride Street, Tower Road, and Buckley Road, shall be fenced. Only type "A" fence (see diagram) shall be installed. All such fence is the property of the Smoky Hill Metropolitan District. This fence shall terminate a minimum of 25 feet from the corner at all intersections to allow proper traffic sight.
All rear and side property lines, which abut parks and park entryways, shall be fenced. All such fence shall be owned and maintained by the Smoky Hill Metropolitan District. The homebuilder will select the type of fence to be installed, but only fence types "B", "D", "E" or "F" (see diagram) may be used.
All rear property lines, which abut the Trails West school site, shall be fenced. All such fence shall be owned and maintained by the homeowner. The homeowner will select the type of fence to be installed. Fence types "A" through "G" are acceptable.
All other rear and side lot fencing will be the responsibility of Smoky Hill 400 homeowners. Fence types "A" through "G" (see diagram) are acceptable.
Only fence type "F" may be installed beyond the front building line of any home. Any such fence shall not completely enclose the front yard.
Where a solid fence borders a street, the rails and posts shall face the lot. The fence pickets shall face the street (see diagram for fence types "A", "C" and "G")
On each lot that abuts a park, and does not have adjacent park access, one gate may be installed for access. No other gates shall be installed at parks without approval from the ARC.
No gates shall be installed in fences that border the school site without approval from the ARC.
No gates shall be installed in fences that border streets without approval from the ARC.
All wood members in fence types "A", "B", "C", "D", "E", "F" and "G" are to be rough or resawn cedar. A homeowner wishing to use an alternate type material must first obtain approval from the ARC.
It is the homeowner's responsibility to notify and obtain the approval of adjacent neighbors prior to the installation of any fence that separate lots along the property line.
It is the responsibility of homeowners with corner lots to insure that their rear or side lot fencing does not interfere with traffic sight on streets.
LANDSCAPING
See Section 5.8 of the Covenant for restrictions on landscaping. No prior approval is required for changes that do not affect the contour of property, interfere with existing water drainage and are located behind a privacy fence. Improvement Requests must include existing and proposed drainage plans.
CONSTRUCTION/REMODELING
No exterior construction or remodeling of any residence, driveway or other structure may be initiated unless prior approval is received from the ARC.
All construction materials must be new. See Section 5 of the Covenants for restrictions on building types, construction and exterior materials.
The homeowner is responsible for the structural soundness of the proposed improvement.
In passing upon proposed plans, specifications and other requirements, the ARC may take into consideration whether the proposed structure and the materials are reasonably suitable for the lot, the harmony with the surroundings, and the effect of the structure as planned on the outlook from adjacent or neighboring property.
It is the responsibility of the homeowner to ensure that construction conforms to city and county building codes. It is also the homeowner's responsibility to obtain all required building permits prior to the start of construction.
RETAINING WALLS
See Section 5 of the Covenants for restrictions on retaining walls.
Retaining walls must not interfere with natural water drainage and must be harmonious with surroundings. Improvement Requests must include existing and proposed drainage plans.
DECKS
Decks that are not visible from the street or from neighboring properties may be constructed and/or remodeled without prior approval from the ARC. All other decks require prior approval.
Construction must be of natural wood color with a natural stain or preservative. Painted wood is not allowed without ARC approval.
It is the responsibility of the homeowner to ensure that construction conforms to city and county building codes relative to setbacks from property lines.
PATIOS AND EXTENSIONS
Patios and extensions that are not visible from the street or from neighboring properties may be constructed and/or remodeled without prior approval from the ARC. All other patios and extensions require prior approval.
It is the responsibility of the homeowner to ensure that construction conforms to city and county building codes.
If a privacy enclosure is requested, it must conform to the fencing guidelines.
PATIO COVERS
Patio covers that are not visible from the street or from neighboring properties may be constructed and/or remodeled without prior approval from the ARC. All other patio covers require prior approval.
Metal or fiberglass covers are not allowed. Canvas covers are acceptable with a sound structural support frame and a color combination that is harmonious with the residence color.
Wood construction must conform to city and county building codes. If wood construction is painted, it must match the color of the residence.
OUTBUILDINGS / SHEDS
See Section 5.6 of the Covenants for restrictions on outbuildings and sheds.
Any outbuilding or shed installed in Smoky Hill 400 that conforms to these guidelines will not require approval from the ARC. Any homeowner who wishes to deviate from these guidelines must submit an Improvement Request to the ARC for approval prior to the start of construction.
Structure must be attached to, or located next to, the main dwelling. Structures may be located along back fence with approval of affected neighbors.
Structure will be painted the same color scheme as the residence. Redwood or cedar may be substituted with prior approval from ARC.
Structure must be located behind an approved enclosure (fence).
Structures must not exceed eight feet from grade to peak of structure.
The maximum size of the structure is 120 square feet.
Roofing materials match dwelling.
It is the responsibility of the homeowner to ensure that construction conforms to city and county building codes. It is also the homeowner's responsibility to obtain all required building permits prior to the start of construction.
DOG RUNS
Dog runs must be concealed from view with an approved fencing enclosure.
ANTENNA AND SATELLITE DISHES
Antennas, including satellite dishes, that are enclosed in home attics or otherwise concealed from view of neighbors do not require ARC approval. All other installations must be submitted for approval prior to installation.
SWAMP COOLERS
Swamp coolers that are concealed from view of neighbors do not require ARC approval. All other installations must be submitted for approval prior to installation.
