Covenant Enforcement

The covenants that are in effect for the subdivision are legally binding on all homeowners. Title companies are supposed to provide copies of the covenants to all new homebuyers. If you did not receive, or have lost your copy, please contact the Homeowners Association for a replacement copy. Violation of the provisions of the covenants may be corrected through the Arapahoe County courts if all simpler remedies fail. Should the violation reach a legal decision in the courts, the violator pays legal fees for the Association.  

The Smoky Hill Homeowners Association employs a Property Management Company to conduct periodic neighborhood covenant inspections and respond to homeowner complaints of covenant violations. Contact is made with the homeowners to notify them of their covenant violation. If the violation is not corrected in a reasonable period of time, subsequent efforts are made to enforce compliance with the covenants. When it becomes obvious that these remedies have not corrected the violation, legal action against the homeowner follows. The Association brings suit against the homeowner to enforce compliance with the covenants. The process may be lengthy, based on the caseload of the courts, but past history indicates the Association normally wins a judgment to force correction of the violation.
